Terms of Service

The agreement between you and Mowable for using the Service.

1. Acceptance of these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and [Company legal name] (“Mowable,” “we,” “us,” or “our”). By creating an account or using the Mowable operations and billing software and related websites and apps (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you confirm you are allowed to accept these Terms for that business. If you do not agree, do not use the Service.

2. The Service

Mowable helps lawn care businesses plan routes, check weather, run a crew app in the field, manage customers and properties, and send invoices and collect payments. We may add, change, or remove features over time. If a change would take away a major feature, we will try to give you fair notice first.

3. Accounts and your responsibilities

You must provide accurate account information and keep it up to date. You are responsible for the activity that happens under your account, including activity by the crew members you invite, and for keeping your login credentials secure. Tell us right away at support@mowable.ai if you think someone used your account without your permission.

You are responsible for the information you enter about your own customers, including having a proper basis to collect and store it, and for using the Service in line with the laws that apply to your business (for example, rules on text and email messaging).

4. Subscription and billing

Mowable is offered on a single flat plan at $69 per month, with every feature included and no per-truck or per-seat fees. By subscribing, you authorize us and our payment processor to charge the payment method on file.

  • Renewal. The subscription is month-to-month and renews automatically each billing period until you cancel.
  • Cancellation. You can cancel at any time. Your subscription stays active through the end of the current billing period, and you will not be charged for the next period.
  • Refunds. [Refund policy to be confirmed by counsel. Unless required by law or stated otherwise here, payments are non-refundable and cancellation stops future charges rather than refunding the current period.]
  • Price changes. We may change the price with advance notice. A change takes effect on your next billing period after the notice.
  • Payment processing. Stripe processes card payments, including the ones you collect from your customers, and charges its standard fee. Mowable adds a 0.5% fee on the card payments you collect from your customers. Payments you record by hand (cash, check, Venmo, Zelle) have no Mowable fee.

5. Acceptable use

You agree not to:

  • use the Service for anything unlawful or fraudulent;
  • upload content you do not have the right to use, or that infringes someone else's rights;
  • send messages through the Service in violation of anti-spam or consent laws;
  • attempt to breach, probe, or disrupt the security or integrity of the Service;
  • reverse engineer or copy the Service except as allowed by law; or
  • use the Service in a way that overloads or interferes with it for others.

6. Customer data and ownership

As between you and Mowable, you own the data you and your crew enter into the Service, including your customer and property records (“Your Data”). You grant us a limited license to host, process, and display Your Data solely to provide and improve the Service and as described in our Privacy Policy.

You can export Your Data while your account is active. After your account closes, we handle Your Data as described in the data retention section of the Privacy Policy.

7. Intellectual property

The Service, including its software, design, and the Mowable name and logo, is owned by Mowable and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active and you comply with these Terms. We reserve all rights not expressly granted.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Tools like route planning and weather guidance are there to help you plan. They are guides, not orders, and the final call is always yours. We do not warrant that the Service will be uninterrupted, error-free, or that forecasts or estimates will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, Mowable will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim. [Liability caps and any carve-outs to be confirmed by counsel.]

10. Termination

You can stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends, though provisions that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.

11. Governing law and disputes
